 Post subject: Legal Advice Wanted

I was recently envolved in an auto accident no my fault and no personal injury, but the vehicle was. We just found out that the person does not have insurance even though she presented the JSO officer with an insurance card. Now I am screwed through my insuance as this person gets off the hook.

Looking for options to seek reimbusement for this.
Any suggestions?

Sorry to hear that. Same thing happened to my brother in law who is a cop. He could't do a thing. 40% of Florida drivers do not have insurance. DRIVE SAFE and be thankful you were not hurt.

Did either of you receive a ticket for the accident? If she did, then you have a very good case, should you decide to take her to small claims court. If no one was ticketed, then you have a tuff row to plow and I would just drop the matter and pay for the repairs out of pocket or better yet, let your insurance company pay for them, as they should. Point there being, it really won't matter if she had insurance or not, being no one was at fault or cited for any infractions.

Actually, your insurance company should pay for the damages and then go after the at fault person to recoup their money..

If you've paid your insurance, you should be fine. Don't forget to collect cash for diminishment of value on your vehicle. Even if you have to have a lawyer write a letter, you should have the car fixed and receive some cash..
The insurance company will initially give you a low number....say $300.00... hold out for more they'll usually come back a day later and give you close to $1000. (depending on your cars current value)

Chris,

Sgtmorris3404 is correct. I got my Florida All Lines Certified Insurance Adjuster Liceense earlier this year and if your insurance is current your insurance will cover you less your deductible and go after the other party if the other party was tickleted. You are covered even if you got a ticket, then your insurance company just can't go after the other party. As long as you didn't get a ticket your insurance should not go up.
